New Federal Proposed Animal Laws! Contact your congressional reps.

A serious threat to our WV State Spay Neuter Fund (WVSNIP) is a federal bill which if passed would kill our state spay neuter funding and reduce our pet food safety!

Say NO to HR 7380   The PURR Act supports only the Federal regulation of Pet food, removing the state entirely from the process.  

Right now, both FDA and the State regulate and inspect pet food.  Why eliminate the state, removing these dollars from the state level and removing a level of safety for pet food with this bill?  This is a bad bill nationally and a bad bill for WV.   

Oppose HR 7380 and help us in WV continue our good work in controlling pet overpopulation and having safe pet food.   Taking WV money out of the state to the federal level would destroy our state grant program.   Call your congressional leaders in Congress – House Reps Mooney and Miller, Sen. Manchin and Capito

Say YES to HR 3894   Greyhound Protection Act :  would outlaw remote gambling and moving greyhounds from interstate commerce. Therefore, it would shut down greyhound racing nationwide and finally the last two tracks in America that are in WV.

It never stops since the slaughter continues with horses being exported to slaughter!  We need this bill!

Say YES to The Save America’s Forgotten Equines (SAFE) Act (H.R. 3475/S. 2037) –
The SAFE Act would permanently prohibit American horses from commercial slaughter by expanding the Dog and Cat Meat Prohibition Act to include equines, prohibit the commercial slaughter of horses in the U.S., and end their export for that purpose abroad.

 

Say YES to H.R.2742/S. 1529 – FIGHT Act

The FIGHT Act, H.R. 2742, would enhance enforcement opportunities under current dogfighting and cockfighting including: banning all simulcasting and gambling on animal fights in the U.S.; halt the shipment of mature roosters (it is already illegal to ship dogs through the mail); allow private right of action against illegal animal fighters; and enhance forfeiture provisions to include real property used in the commission of an animal fighting crime.

This bill expands protections of animals provided under the Animal Welfare Act, including by prohibiting any (1) broadcasts from international, interstate, or intrastate sources of animal fighting ventures in the United States or U.S. territories; and (2) shipments or transport of certain mature roosters.

WVSNP 2024 has more money than in past years! Thanks to FOHO WV and MZM.

WVSNP grant?  There is more money available now than in past years thanks to FOHO WV.  $450,000 additional dollars were added to the WVSNP fund as a grant from Mug-Z-Moo fund given to FOHO WV for spay neuter throughout our state.   In 2017, when FOHO WV’s bill got funding for the state grant, they requested $900,000 but were only granted by law approximately $450,000.    (Remember, this is not taxpayer dollars!)

This additional money actually provides full funding to the state grant!
And, thank you FOHO WV for the WVSNP program and now for its additional funding.  We also want to thank the WV Dept of Agriculture for its strong support and administration of this fund.   We have not forgotten those volunteers who sit on the WV Spay Neuter Advisory Committee too.

Here is what we know.  Unwanted animals leads to abuse, neglect and abandonment!  Spay Neuter is needed!

Animal Welfare lost two champions on 1.24.24.

FOHO lost two dedicated animal advocates on 1.24.24.  Both passed on the same day. They both started FOHO WV years ago in 1994 and have worked tirelessly over the years in their dedication to animal welfare throughout our state.

 

Sylvia Shafer became part of the animal welfare movement in 1982 by joining a local group called Kanawha Action for Animals. In the year 1984, she became a mem­ber of the board of directors of the Kanawha/Charleston Humane Association (KCHA.)

She retired from Bell Atlantic Phone Company in 1988 and two days later became the executive director of KCHA. This is the largest animal shelter in WV. For several years this shelter had not prosecuted cruelty to animals: this became a priority for Sylvia.

She soon realized how terrible animal laws were in this state, when five horses were returned to their owner after she had been found guilty. Sylvia knew what she must do, and that was change the law.

Sylvia has worked with the legisla­ture since 1989 and, with the help of FOHO and many private citizens, has been effective.  More laws need to be changed: with the help of many caring people this can be accomplished.  Sylvia retired as executive director in the year of 2000 of KCHA and in 2001 re­joined the board of directors and was the treasurer for many years.  Sylvia served as the main lobbyist for West Virginia Voters for Animal Welfare. Sylvia also served on the Dept. of Agric. Advisory Committee for the WVSNP program since 2017 to the present.  Sylvia lived in Charleston with her dog and until one year ago she had her beloved husband Vaughn with her until he passed.  He always supported her effort in animal welfare.

 

Betty Burkett was on the board of FOHO since 1994 and was president of FOHO for many years.  This lifelong WV resident was married with two grown children. Her list of contributions to animal welfare in West Virginia is lengthy.

Betty was founder and chair for three years of the annual Rescue League dog walk, March for Mutts, which is still ongoing and highly successful.  A 25-year member of the Marshall County Animal Rescue League, she held the positions of secretary and treasurer in the past. She was chair of the Moundsville Animal Task Force, which was successful in getting a cat leash law and a regulated anti-tethering ordinance for dogs passed into city code. She also serves on the board of the Olive Branch Animal Rescue and Refuge in Sistersville, Tyler County.

Betty coordinated two cat spay and neuter programs: one sponsored by the city, called Moundsville SNAP, and one for the Rescue League, called CAT-SNIP. She ran the FOHO SNAP/WV program and sat on the WV Veterinary Licensing Board as a lay member. She also did a small amount of animal transport. For several years Betty visited elementary schools with one of her dogs to present a Safety Around Dogs Program to the students.

Betty worked as a Licensed Practical Nurse for 28 years in a hospital setting. An Elder in her church, she was active on several other committees. She loved to read, work in her flower garden, and take walks with her dogs. She also has had several cats and dogs over the years.  All of her animals have been adopted from the animal shelters where Betty has volunteered.

VetStart WV could have helped with our vet shortage in the state!

The VetStart WV program did not get funded in the budget in the 2024 WV Legislature.   Its supporters will likely try again in the future. 

WV has a veterinarian shortage just as the rest of the nation does.  It has become apparent as our state has implemented the WVSNP program and received additional out of state funding to FOHO WV from the MZM Foundation to further support the spay neuter effort.  We are forever grateful for the funding but it does show that our lack of vets is an issue.

However, there may be a solution with the effort to start the first four-year veterinary technology program, VetStart West Virginia. It is a program academically based at West Virginia’s Land Grant Universities (West Virginia University and West Virginia State University). The intent is to have veterinary technicians/technologists assisting veterinarians thus freeing them to perform more essential duties and foremost for FOHO even more spay neuter procedures.  The AVMA suggests 4 veterinary techs to 1 veterinarian but in WV the ratio is 1 veterinary tech to 9 veterinarians. It makes sense that this nationwide veterinarian shortage which is so negatively impacting WV could be helped with this program. What can we in the animal welfare community do to help this program get started? There is budget funding needed from the WV State Legislature for the VetStart Program. You can read more about the program below. Then call your legislators on the Senate and House Finance Committees to support the budget funding request by the Dept. of AG for the VetStart WV program.

You can visit fohowv.org to see the list of counties and the vet availability in each of those counties.

If there is a Delegate or Senator from your area on one of these committees, please reach out to them and the chair and vice chair of the committee.  It would be prudent to contact all the committee members to seek their support.  If you are a recipient of the grant money tell your story of success & how you & WV need this VetStart program.   This may be our solution for increased spay neuters in our state.  With this national crisis of a vet shortage, WV will have trouble competing.  We need to reach for the low hanging fruit and get what we can to assist the veterinarians in our state.   It cannot hurt to offer the 4 year degree either for our young people in their career choice.

WV has dropped the ball in regard to animal law….

 

In Animal protection laws, West Virginia has dropped to #20

In the past, West Virginia has ranked in the top tier in the ALDF rankings and has been in the top tier since the list began in 2006. However, falling to Number  20  in 2021 is a sign our state is failing, and part of that is failure to enforce the laws in place.

  • Veterinarians must report suspected animal cruelty, and have immunity for doing so
  • +Mandatory post-conviction forfeiture and possession bans
  • No prohibition on sexual assault of an animal
  • Standards for minimum acceptable care for animals (e.g. necessary food, water, shelter) are not well-defined
  • No felony provisions for abandonment or neglect of animals

We understand that most think we have the worst animal protection laws in the nation.  That is not so.  Our problem is enforcement.  Just getting the proper officials to apply the law and enforce it is key.    But our drop in ranking is a red flag that we need to fix our loopholes, get a shelter definition bill passed, put more pressure on locally for everyone to report cruelty when they see it and have officials enforce the laws we have.

Charleston animal advocates concerned about Petland!

WVVAW has a strong position against puppy mills.   We worked with HSUS to obtain WV Legislation, the Commercial Dog Breeder’s Law 19.20.26 in 2013.   Approx. 15 counties have set fees for breeders within their counties.   Regardless of their laxness in setting fees, the law still applies to any commercial breeder within the state of WV. The fees collected are to be used for animal shelters, animal rescue and spay neuter programs administered by county animal shelters or other humane organizations. spay neuter.

There is concern of the treatment of animals, acquiring puppies from known puppy mills/brokers, deceptive tactics & lack of transparency.

Federal bill to end Greyhound Racing in America!!

Finally, there is a federal bill to end the horror of greyhound racing in the United States!
The Greyhound Protection Act 2020 now has a bill # H.R. 7826.
Join many of the animal advocacy groups throughout WV in signing on in support of this bill.  Just let us know!

It is difficult to read about the cruelty to the rabbits used in live lure training. The industry say it no longer does this. This undercover article tells another barbaric story.   Greyhound racing is a cruel industry!   Please let’s end it in WV in 2021!
